GENERAL TERMS OF USE

Effective as of July 1, 2024

The purpose of the present General Terms of Use (known as "GTU") is to provide a legal framework for the terms and conditions for the use of the website https://thenailsangels.com and associated services provided by TheNailsAngels OÜ and to define the conditions of access and use of the services by the "User".

The present GTUs are accessible on the site under the section "Legal Notice".

Any registration or use of the site implies the acceptance without any reserve or restriction of the present GTUs by the user. When registering on the site via the Customer Area Creation Form, each user expressly accepts these conditions.

In case of non-acceptance of the GTUs stipulated in this contract, the User must renounce access to the services offered by the site.

TheNailsAngels OÜ reserves the right to modify unilaterally and at any time the content of the present GTUs.

The present GTUs do not replace the General Terms and Conditions of Sale which also apply when the User decides to buy products via the website https://thenailsangels.com and which are available on the page "General Terms and Conditions of Sale".

ARTICLE 2: Access to the site

The site https://thenailsangels.com allows the User free access to the following services:

• Presentation of the products offered by the Company;
• Online ordering service for products offered by the Company;
• Customer area for order tracking;
• Service management area for ambassadors;
• Customer service contact form;
• Consultation and addition of product reviews and photos.

The site is accessible free of charge from any location to any User with Internet access. All costs incurred by the User to access the service (computer hardware, software, Internet connection, etc.) are at the User's expense.

The non-member User does not have access to the reserved services. To do so, they must register by filling out the form. By agreeing to register for the reserved services, the member User undertakes to provide truthful and accurate information concerning his civil status and contact details, particularly his email address.

To access the services, the User must then identify himself using his email address and his password which was chosen at the time of his registration.

Any User who is a regularly registered member may also request to be removed from the list by contacting customer service at the following email address: help@thenailsangels.com. This will be effective within a reasonable time.

Any event due to a case of force majeure resulting in a malfunction of the site or server and subject to any interruption or modification in case of maintenance, does not engage the responsibility of https://thenailsangels.com. In these cases, the User agrees not to hold the publisher responsible for any interruption or suspension of service, even without notice.

The User has the possibility of contacting the site by electronic mail at the email address of the publisher communicated in ARTICLE 1.

ARTICLE 3 : Data collection

The site ensures the User a collection and a treatment of personal information in the respect of the modalities foreseen by the applicable legislation in force.

The User must request prior authorisation from the site for any reproduction, publication or copy of the various contents. The user agrees to use the contents of the site in a strictly private context, any use for commercial and advertising purposes is strictly prohibited.

Any total or partial representation of this site by any process whatsoever, without the express permission of the operator of the website would constitute an infringement punishable by the legal provisions in force.

The publishing company undertakes to include the member's name near each use of its publication.

Any content put online by the User is of his sole responsibility. The User undertakes not to put online any content that may harm the interests of third parties. Any legal action taken by an injured third party against the site will be borne by the User.

The User's content may be deleted or modified by the site at any time and for any reason, without notice.

ARTICLE 9: Applicable law and jurisdiction

The present GTUs will be interpreted, as well as the legal relations between the parties, in accordance with French law.

The User irrevocably agrees to submit any dispute arising from, or in connection with, the validity, interpretation and/or execution of these GTUs to the exclusive jurisdiction of the Luxembourg courts.

Without prejudice to the foregoing, the Publisher may, at its discretion, bring any claim or dispute (including, but not limited to, seeking injunctive and/or equitable relief) arising out of or in connection with the validity, interpretation and/or performance of these GTUs before any court or administrative authority in any jurisdiction having jurisdiction over the subject matter of such claim or dispute.

The present GTUs are written in French language. In the event that they are translated into one or more foreign languages, only the French text will be deemed authentic in the event of a dispute.
